Mediator's Comments: By profession I am a lawyer. I was called to the Bar in 1975 and for more than 20 years I had a full-time law practice in Victoria, a significant proportion of which was in family law. I was honoured within my profession in 1993 by receiving an appointment as Queen’s Counsel. I am currently a retired member of the Law Society.

By the mid 1990s I preferred alternative-to-court processes for resolving family law disputes. I shifted my law practice from litigation to mediation and arbitration. I became qualified under the Law Society rules as a family law mediator, and took advanced civil mediation courses. I was designated a Chartered Mediator (1997), and became a member of the Civil Roster (1999) and the Family Roster (2001) when those rosters were created. I undertook private mediations and arbitrations of all kinds, including many and varied mediations in the family law area, with and without the parties’ lawyers present. I was President of the B.C. Mediator Roster Society (2002 - 2006), and in 2008 I became a board member of the BC Dispute Resolution Practicum Society. I am currently on the interim board charged with bringing together those two organizations into a new dispute resolution organization in BC.

In addition to my private practice of law and mediation, I have held various public positions, all of which have involved issues related to children and families. From 2003 to 2006 I was Child and Youth Officer for British Columbia – an independent child advocate position. Most recently (2008 - 2009) I was a Commissioner on Canada’s Indian Residential School Truth and Reconciliation Commission. I have been Chair of the Compensation Panel, Jericho Individual Compensation Program (1996 -2001), Official Trustee of the Legal Services Society (2002 - 2003), a Governor (1991 - 1999) and Chair (1998 - 1999) of the Law Foundation of B.C. and a public representative on the Council and Executive of the B.C. College of Physicians and Surgeons (1994 – 2001).

I am a contributor to the CLE Family Practice Manual, and to the updated CLE Family Agreements Manual, and have taught family law at the University of Victoria and at the Institute of Conflict Analysis and Management. I have written articles and made presentations about family law and mediation. (See my website www.janemorley.com)

I value the flexibility of mediation and the self-determination it allows to the parties, both in terms of process and the substance of any agreement. I am convinced that resolving issues arising from marital breakdowns through mediation makes good sense, particularly when children are involved.
